Terms and conditions for the processing of personal data – Goethe-Zertifikat

1. The person concerned (student/legal representative of the student) acknowledges that the controller, University of Žilina, Univerzitná 8215/1, 010 26 Žilina, ID No.: 00 397 563 (hereinafter referred to as "UNIZA") will process his/her personal data to the extent specified in the application form for the Goethe-Zertifikat exam at the Institute of Lifelong Learning UNIZA; this is personal data:
a) name and surname, title, date of birth, street, city/municipality, postcode, telephone number, e-mail address, account number, signature,
b) on the student's disability (only at the student's request if the exam conditions need to be adjusted),
c) concerning the student's legal representative - his/her name and surname, street, city/municipality, postcode, telephone number, e-mail address, account number, and signature.
2. The purpose of the processing is:
a) for personal data under 1(a), is the maintenance of the list of students registered for the Goethe-Zertifikat, the communication of UNIZA with students, and the subsequent examination of students,
b) for the personal data under 1(b), to keep a list of students who have requested to adjust the exam conditions and to ensure that these conditions are adjusted accordingly,
c) for the personal data under 1(c), is the identification and, where appropriate, assessment of the authorization to submit an application form on behalf of the student, and communication with the legal representatives of the registered persons.
3. In case of failure to provide personal data according to 1(a) and 1(c) of these conditions, UNIZA will not be able to keep the student on the list of students registered for the Goethe-Zertifikat and enable him/her to take this exam. In case of failure to provide personal data according to 1b) of these conditions, UNIZA will not be able to ensure the adjustment of the exam conditions for a student with a disability.
4. The person concerned acknowledges that:
a) the legal basis for the processing of the personal data specified in the Application Form according to 1(a) and 1(c) is the fulfilment of contractual obligations according to Article 6(1)(b) of the Regulation as defined below in Point 7 of this document,
b) the legal basis for the processing of the personal data provided according to 1(b) is the explicit consent of the person concerned or legal representative according to Article 6(1)(a) in conjunction with Article 9(2)(a) of the Regulation, as defined below in Point 7 of this document.
5. The contact details of the responsible person designated by UNIZA for the protection of personal data are e-mail: zodpovedna.osoba@uniza.sk, or Univerzitná 8215/1, 010 26 Žilina.
6. The personal data provided will be kept for the necessary period of time required for the purpose of their provision and the fulfilment of UNIZA's archiving obligations laid down by law. Personal data processed on the basis of the consent given by the person concerned will be disposed of in the event of his/her withdrawal.
7. UNIZA informs the person concerned of the following rights arising from Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and Act No. 18/2018 Coll. on the protection of personal data and on amendments to certain Acts:
a) the right to request from UNIZA access to the personal data provided, to obtain confirmation that his/her personal data is being processed, and related information,
b) the right to rectification of personal data in case of incorrect or incomplete personal data,
c) the right to erasure of personal data where the legal prerequisites for the erasure of personal data are met ("right to be forgotten"),
d) the right to restrict the processing of personal data if the legal prerequisites for restricting the processing of personal data are met,
e) the right to the portability of personal data provided to UNIZA if the legal prerequisites for the portability of personal data are met,
f) the right to withdraw your consent to the processing of personal data - consent can be withdrawn at any time in writing to the contact details referred to in paragraph 5 of these terms and conditions.
g) the right to initiate the proceedings at the Office for Personal Data Protection to determine whether the rights of natural persons have been violated in the processing of their personal data or whether there has been a violation of applicable legislation,
8. UNIZA confirms that the personal data provided is not processed through automated individual decision-making and profiling.
9. UNIZA confirms that the transfer of personal data to third countries (outside the EU and EEA countries) or international organisations is not carried out.
